1. Acceptance of Terms
By accessing or using the Make Our Government Accountable (MOGA) website located at makeourgovaccountable.com, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, you may not access or use the platform.
2. Platform Purpose & Non-Governmental Status
MOGA is an independent, non-partisan civic technology platform operated by Make Our Government Accountable, LLC. MOGA is intended solely for educational, advocacy, and civic transparency purposes.
Official Government Disclaimer: MOGA is NOT an official government agency, election authority, or legislative body, nor is it affiliated with or endorsed by Congress.gov, the U.S. Congress, or any state or local election board. Participating in shadow-voting or verification on MOGA does NOT constitute official voter registration, cast an official ballot in any government election, or confer any official legal status.
3. Eligibility & Identity Verification
To register an account or participate as a “Verified Voter” on MOGA:
- You must be at least 17 years of age (eligible for voter pre-registration or active voter status).
- You must provide accurate, truthful identity information matching public residential records for verification purposes.
- You agree to verify only your own identity. Registering multiple accounts, impersonating another individual, or utilizing fraudulent credentials is strictly prohibited and grounds for immediate termination.
4. User Conduct & Integrity Protections
We maintain a strict “One Person, One Address, One Vote” standard to uphold constituent sentiment integrity:
Prohibition of Automated Systems: The use of bots, scripts, automated web scrapers, or software to manipulate vote tallies or simulate user activity is strictly forbidden.
Behavioral Shield Enforcement: Our platform employs real-time behavioral monitoring to detect and block automated activity. MOGA reserves the right to suspend or block access to IP addresses, dynamic tokens, or accounts exhibiting malicious or bot-like behavior.
5. "Verified Voter" vs. "Community" Voting
MOGA maintains two separate sentiment aggregation tiers:
Community Sentiment: Open to general site visitors for informal feedback. Results represent general public interest and are not compiled into official constituent legislative briefs.
Verified Voter Sentiment: Reserved strictly for users who pass our Electronic Know Your Customer (eKYC) residential verification. These results are compiled as high-integrity constituent data and reported to relevant elected officials.
6. Intellectual Property & Aggregated Data Rights
The software, source code, visual designs, cryptographic hashing architecture, logos, and trademarks on MOGA are the exclusive property of Make Our Government Accountable, LLC.
While your individual vote choices remain completely decoupled and anonymized under our cryptographic protocol, you grant MOGA a perpetual, royalty-free license to aggregate, publish, distribute, and transmit anonymized district-level voting tallies and statistical summaries to elected officials, public media, and civic researchers.
7. Disclaimer of Warranties
The platform and all legislative data derived from third-party APIs (including Congress.gov and Vote.org) are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied. MOGA does not warrant that the platform will be uninterrupted, error-free, or that external legislative feeds will reflect real-time floor changes instantaneously.
8. Limitation of Liability
To the maximum extent permitted by law, Make Our Government Accountable, LLC, its officers, directors, and employees shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your access to or inability to access the platform, third-party API downtime, or any reliance placed on legislative data made available on the site.
9. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Wake County or Raleigh, North Carolina.
